1. Introduction

Welcome to Brands byluigi. By accessing our website and purchasing our products, you agree to be bound by these Terms & Conditions. Please read them carefully before using our services.

2. Definitions

Consumer: A natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur.

Cooling-off Period: The period during which the consumer may exercise their right of withdrawal.

Day: Calendar day.

Durable Medium: Any means that enables information to be stored in a way that allows future consultation and unaltered reproduction.

3. Applicability

These Terms & Conditions apply to every offer made by Brands byluigi and to every distance contract concluded between Brands byluigi and the consumer.

4. The Offer

  • If an offer has a limited validity period or is subject to conditions, this will be clearly stated.
  • The offer includes a clear and accurate description of the products offered, allowing the consumer to properly assess the product.

5. The Contract

  • The contract is concluded at the moment the consumer accepts the offer and meets the stated conditions.
  • If acceptance occurs electronically, Brands byluigi will confirm receipt electronically without delay.

6. Right of Withdrawal – Custom-Made Products

Due to the custom-made and personalized nature of our products, the right of withdrawal does not apply.

All Brands byluigi products are made according to the consumer’s specifications, including but not limited to:

  • Player name and number
  • Shirt size and fit
  • Design, colors, and prints

Once production begins, the product cannot be returned or exchanged.

This exclusion is permitted under applicable consumer protection laws for products manufactured according to the consumer’s specifications.

7. Obligations of the Consumer

The consumer is responsible for:

  • Providing accurate personalization details (name, number, size, design)
  • Reviewing the order confirmation carefully before finalizing the purchase
  • Providing a correct delivery address and valid contact details

Brands byluigi is not responsible for errors provided by the consumer.

8. Damaged or Defective Products

If a product arrives damaged, defective, or with a production error:

  • The consumer must notify Brands byluigi within 7 days of delivery
  • Contact must be made via info@brandsbyluigi.nl
  • The consumer must provide the order number, clear photos, and a description of the issue

9. Obligations of Brands byluigi in Case of Defects

If Brands byluigi confirms a defect or error on our part, we will:

  • Provide a replacement at no additional cost, or
  • Issue a full refund within 14 days

Refunds will be made using the original payment method, unless otherwise agreed.

10. Exclusion of the Right of Withdrawal

The right of withdrawal is excluded because:

  • Products are custom-made according to consumer specifications
  • Products are not prefabricated
  • Products cannot be resold once production has started

11. Prices

  • Prices will not be increased during the validity period of an offer, except for VAT changes
  • All prices include VAT unless stated otherwise
  • Shipping costs are clearly displayed before checkout

12. Compliance and Warranty

Brands byluigi guarantees that all products:

  • Conform to the contract and offer description
  • Meet reasonable standards of quality and durability
  • Are produced according to the personalization provided
  • Comply with applicable laws at the time of contract conclusion

13. Delivery and Execution

  • Orders are handled with due care
  • Delivery takes place at the address provided by the consumer
  • Estimated delivery times are shown at checkout
  • In case of delays or inability to fulfill an order, the consumer will be informed promptly

14. Payment

  • Payment is due immediately upon checkout unless otherwise agreed
  • The consumer must report payment inaccuracies without delay
  • Payments are processed securely through approved payment providers

15. Complaints Procedure

  • Complaints must be submitted clearly and completely to info@brandsbyluigi.nl
  • Complaints will be answered within 14 days
  • If more time is required, the consumer will receive an update

16. Intellectual Property

  • Designs and branding of Brands byluigi remain the property of Brands byluigi
  • Uploaded personalization content remains the responsibility of the consumer
  • Custom football shirts are fan-made products and Brands byluigi is not affiliated with or endorsed by any football club, league, or brand

17. Disputes

  • All agreements are governed exclusively by Dutch law
  • Disputes will be submitted to the competent court in the Netherlands

18. Additional or Deviating Provisions

Any additional or deviating provisions must not disadvantage the consumer and must be recorded in writing or on a durable medium.
